922r Compliance

Probably a silly question but here it goes. Of all the sites that talk about 922r compliance, has there ever been a Benelli owner that has had there weapon confiscated by a federal agent or any other agency, broken down and had weapon parts checked part for part in order to gain compliance? I'm sure there could be a lot of "what if" answers. I'm looking for a direct answer to the question.

...the reading Ive done in the forums everyone refers to it as a "tack-on" charge..Meaning nobody really enforces it or looks for offenders but when "They" come busting down your door for your underage Beastiality midget porn they will find it and use it against you.

So basically its the difference in getting out of prison in time to buy the new e-phone 12... or getting out in time for the e-phone 14

I try not to gamble with felonies, particularly when protecting yourself is relatively easy these days.

You have a lot of options these days with the M4;

1. US made stocks

2. US made hammers

3. US made triggers

4. US made disconnectors

5. US made trigger frames

6. US made handguards

7. US made followers

8. US made full length magazine tubes

This is good advice people. For me at this point in my life I always ask myself; what do I have to lose? And the answer is always the same- A LOT.

Most times I think, when people get caught with "illegal" stuff, it happens purely by accident- peripheral to some other event that happens beyond one's control. Like, you're involved in a serious accident and incapacitated while transporting a gun/guns, and the cops take protective custody of them.

Some stupid thing like that.

Where I get confused is in the fact that I purchase a Benelli M4 because I want , as far as I'm concerned, the finest semi automatic defense shot gun made. The base model weapon is 100% legal in this great country of ours. I would like to add a Benelli full length magazine tube and a Benelli collapsible stock. After all it is a Benelli M4 and I would like to keep it all Benelli. Now I have to remove X number of Benelli parts which make the Benelli M4 the great shotgun that it is and replace with US parts. I am probably fairly certain that a Benelli M4 has been used in the commission of a crime at some point in time or been on a property where a crime has been committed and confiscated by the police. I still find it hard pressed that a local authority is going to call a federal agency to come and strip that weapon down part for part to see if its compliant. Even in that last scenario can anyone tell me if there has been anybody in our great country that has ever been prosecuted under any circumstance at all, anywhere, anytime for not having a Benelli M4 922r compliant. I think that we all know the answer to this question. As for me and my Benelli M4, it will stay 100% Benelli and I will have no problem sleeping at night.

You're not really confused about the issue, are you? You know what the law is. That's why you posed the question. Whether you comply with it or not is your choice, as it is for everyone.

Yes sir I do know the law. Where I am confused or frustrated is all the endless Hype on being 922r compliant. Removing perfectly engineered parts form a weapon based on a law that has never been enforced, as far as I know, on the Benelli M4. It is most certainly a choice. I guess where I get frustrated is the tone of those particular blogs makes it seem like if you don't remove these parts by the numbers then you will somehow be at great risk of federal prosecution, This is simply not true nor should it be insinuated or implied . Our government on a state and federal level will not even enforce our immigration laws which are so blatantly violated every day. I don't mean to get off topic. I most certainly appreciate the education on switching out parts by the numbers and making a conscience choice to comply or not but lets keep the consequences realistic if you choose not to.

Dude, I think it's been made clear here that there aren't guys field stripping M4's at gun ranges to determine 922r compliance.

It's an addon FELONY.

Did you hear the word FELONY? Could be a misdemeaner, but I'll bet when it's compounded with whatever else, it would be a FELONY.

So when the Gubment is nailing your hide to the wall for the primary offence, they can get bonus points for an illegal gun charge. SCORE!

They put Freakin' Martha Stewart in prison for God's sake. Who are you?

You want to play with BATF? That's your business and ya takes ya chances.

But if I was gonna play that game? I wouldn't be shooting my mouth off about it on the Internet...

That's just bad playin' technique in my opinion.

"Dude",

I'm 56 years old and would prefer a little more respect than the level of "Dude". I will start out by giving you the level of respect of "Sir" I am the OP of this blog. It's got away from the original intent of my question. It appears that I have the answer to my question and the answer is no. There most likely have never been added charges as you say or any prosecution in regards to specifically, the Benelli M4 not being 922r compliant. I was simply asking if anyone had one example of this happening. I did not realize that I would have struck such a nerve.

To put it simply, it is plain and simple fear of the Government. What may be ignored today may not be ignored tomorrow. It depends who is in power and what they feel like enforcing.

With most of the aftermarket components out there, you have a bunch of high quality parts that meet or exceed the original OEM component's function or performance. So it isn't like we're slapping Tapco parts on the weapon in order to comply.

Thank you as always. This is a constructive answer that I can live with. I've enjoyed this debate with all.

Well...

Ya got a "Dude" anyhow, now ya gotta live with it.

After you go on for two pages about contemplating committing a felony, what did you really expect.

How about Use the search button your royal majesty, use 922r as your search parameter and revel in how much this has been discussed here and elsewhere I suspect.

Is that more to your liking? How do ya like me now? (gratuitous Toby Keith reference, everybody likes him except the Dixie Chicks)

No, you are wrong. It does put yourself at risk for prosecution if you're caught. The consequences are written within the law, they are not implied or insinuated. They are written in the statute. It's not hype to be afraid of felony prosecution.

There is risk if you don't comply. Don't pretend that there isn't.

If you think that there's not a snowball's chance of you ever getting caught then, go ahead, it's your ass on the line.

But don't expect that everyone should agree with you.

My take on your attitude is that you don't like the law, you think it's absurd to have to replace perfectly good parts, and therefore, you don't want to follow it for those reasons.

Also, it's plain to see from your posts, that it angers you to read that a whole lot of people are afraid of being caught, and for that reason alone, they will comply. You choose to rail about people who are following the law and warn others, either from fear or maybe just because it's the law.

You got pissed off because you didn't get the answers from people that you wanted to see. Finally, when someone explains it to you like you're a 3-year old who wants to know why they can't have another piece of candy, THEN you're Ok.

Get over yourself. No one knows your age or cares. So if being referred to as "dude" or anything of the like is remotely offensive to you, you might want to avoid the internet. This isn't safe territory. Respect is earned and rarely just freely given.

Personally...

I don't screw with an agency that may kick my door in and shoot my Cocker Spaniel because he barked at them. There is zero percentage in screwing around with Firearms laws in a land that is becoming more "Progressive" if ya know what I mean.

This is a Firearm law, it ain't double parkin'

Maybe he'll get to serve his time in a Federal Prison, I hear they're nice...

I'll bet everybody calls ya "Sir" there... and says , Pardon me and You're welcome! Who knows, they might even pick your soap up for ya if ya drop it in the shower.

They might even cut the crust off your Baloney Samiches...

I get it gentleman and believe it or not I do have a teachable spirit. Some of what you say is true on how I really feel about the law. The law is the law. Part of my thinking was after market companies are manufacturing sub standard parts to sell based on everyone's fear of a law that has never been tested when it comes to the Benelli M4. Again this was not the intent of my question.

As far as the 3 year old comment, how do you think I feel when I have to repeat the same question over and over and getting these comments back from left field. Here we go again:

DOES ANYONE KNOW OF EVEN ONE SCITUATIN WHERE ANYONE EVER HAD THEIR BENELLI M4 CONFISCATED,BROKEN DOWN AND PROSECUTED FOR NON COMPLIENCE OF 922R UNDER ANY CIRCUMSTANCE WETHER IN THE COMMISION OF A CRIME OR NOT ????

I know the consequences of not complying with a federal law. If the federal government wants to prosecute someone for having a collapsible stock or a 7 round magazine tube on there weapon so be it . I GET IT!!!!!!!!! This was still not answering my initial question.

The question gentleman has since been answered by several people.

Blessings

No

i know know a guy who works at the ATF

He stated they do not have the resources, energy or desire to track down 922r violations

Think of them as “add on” charges

that is all, do what you will, I don’t care

As for me, I don’t think I will give anyone fuel for a fire.

I like my butt exactly as it is, I would not care much for prison

"I stand to be corrected"

Last week a friend of my step son went to a gun show here in Texas. He was trying to sell a custom built AR platform. I believe that it had a 14" barrel with a collapsible stock. A individual approached him, asked if it was his weapon. He stated yes. The individual displayed a badge and stated that he was with the ATF. He began to explain to my stepsons friend that his weapon platform was not legal and that if prosecuted he could serve time in a federal prison. The ATF agent told him to remove the retractable stock in his presence which with the help of others he was able to do. By the grace of God, everything worked out ok. This certainly opened my eyes in taking 922r compliance seriously.

Happy New Year to all... Blessings
